ORDINANCE NO. 09-3566
AN ORDINANCE OF THE CITY COUNCIL OF LEBANON TO ESTABLISH A LANDSCAPE WATERING PROGRAM

WHEREAS, sewer bills for the residential customers of the City of Lebanon water and sewer services reflect actual water usage for the residence so that water bills and sewer bills match; and

WHEREAS, the City of Lebanon wishes to establish a landscape watering program so that the citizens of Lebanon can water their yards and landscaped areas without the use of such amount of water being reflected on their sewer bill; and

WHEREAS, such program would cap the sewer bill of any customer within the city limits of Lebanon at sixty dollars ($60.00) and the sewer bill of any customer outside of the city limits of Lebanon at ninety dollars ($90.00) regardless of water usage; and

WHEREAS, such caps eliminate the need for water leak adjustments and swimming pool adjustments to sewer bills, whereby Resolution No. 04-1202 and Ordinance No. 06-2946 were amended, which established water leak adjustments and sewer rates, respectively; and

WHEREAS, water leak adjustments for leaks over one hundred dollars ($100.00) may still be granted on case by case basis by the Commissioner of Finance with written notice provided to the Lebanon City Council; and

WHEREAS, such program would only apply to residential customers and would have no effect on commercial or industrial customers; and

WHEREAS, such program would start on August 1, 2009, and would sunset on November 1, 2010, for purposes of reevaluation.

NOW, THEREFORE, BE IT ORDAINED by the City of Lebanon, Tennessee, as follows:

Section 1.The Mayor and the Commissioner of Finance and Revenue are hereby authorized to establish a Landscape Watering Program, reflected in the attached schedules, incorporated herein by reference as if appearing verbatim, and subject to the following guidelines:

A. Such program shall begin on August 1, 2009, and will end on November 1, 2010, at which time it will be reevaluated for the purpose of effectiveness;

B. Such program shall provide a cap of sixty dollars ($60.00) for the residential sewer bills of customers within the city limits of Lebanon and of ninety dollars ($90.00) for the residential sewer bills of customers outside of the city limits of Lebanon regardless of the amount of water usage reflected in the water bills;

C. Notwithstanding the provisions of Resolution No. 04-1202 and Ordinance No. 06-2946, which established water leak adjustments and sewer rates, respectively, all water leak and swimming pool adjustments are hereby eliminated with the implementation of the sewer bill caps;

D. Water leak adjustments greater than one hundred dollars ($100.00) may still be granted on a case by case basis by the Commissioner of Finance, with written notice provided to the Lebanon City Council;

E. This ordinance shall not affect commercial or industrial customers.

Section 2.This ordinance shall take effect immediately upon its passage, the public welfare requiring the same.
